520 _aChD 5 February 1987. An originating summons by the plaintiffs (L) seeking a declaration as to a point on the construction of a lease. Premises were granted to L for a 125-year term from 5 July 1973, pursuant to a building agreement for the erection of offices and a hotel on a site in Bristol. There was provision for a basic rent for the first seven years, subject thereafter to review. Work on the development was to begin by 31 March 1971. In dispute was the clause which provided that if road works had not been carried out by 31 March 1973, the first review date should be delayed by one year for every year or part of a year of delay until 1) completion of the works, or 2) notification by the landlords that they would not be carried out. The lease repeated this proviso, but was in the past tense as time the works had not been carried out.
