520 _aCA 30 June 1998. Landlord council T issued possession proceedings against B, alleging that they were guilty of nuisance to their neighbours in breach of their tenancy agreement. B served notice to exercise their right to buy. T refused to process the application and the second appellant sought declaration that B was entitled to acquire the freehold. The possession order and application for declaration came before the recorder on the same day, and he decided to hear the possession order first. Appeal against this decision was dismissed.
