Contracts were exchanged but when P came to move into the house it was unihabitable and he claimed the survey was negligent. Judge awarded P damages equivalent to the diminution of value plus stamp suty, general damages for discomfort and damages for mortgage interest payments, endowment policy premiums and insurance premiums. H appealed, claiming they were only liable for diminution of value plus stamp duty. Appeal allowed. | ||
