520 _aSummarises the main points of the case "Redland Aggregates v Shepherd Hill" which related to the dispute procedure of the FCEC Blue form of subcontract. Under this procedure, if any dispute arises in connection with the main contract which concerns the subcontract works, the contractor may require the dispute to be dealt with jointly with the dispute under the main contract. The contract does not, however, impose any timetable on the contractor to invoke arbitration. CA ruled that if the contractor is unwilling to bring about a tripartite arbitration, the subcontractor may proceed with an arbitration against the contractor only.
