When a dispute arose and the arbitrator was appointed the contractor claimed rectification of the contract on the grounds of either a mutual or unilateral mistake, and damages for innocent misrepresentation or negligent mis-statement. The employer contended that the arbitrator had no jurisdiction under the arbitration clause to order rectification of the contract, nor did he have the power to grant relief for misrepresentation.
