The company appealed under Town and Country Planning Act 1990 s78 and the Planning (Listed Buildings and Conservation Areas) Act 1990 s20 to the SoS against non-determination. The planning authority sought judicial review prohibiting the SoS from holding an inquiry on the grounds that there was no jurisdiction to hear an appeal since no valid application had been lodged. Appeal dismissed.
