_v(9932) 14 August 1999, 89-91(3)
520 _aCA 31 May 1999. In May 1965, Mrs H was the sole beneficiary of a farm when her husband died intestate. In 1983, Mrs Hartley died. She had four children, one son who lived on the farm and three daughters (the plaintiffs). The defendant (H) moved in with the son in July 1992 and in October 1995, they were married. On 9 November 1995 the son made a will and 14 November, he died. The plaintiffs (E) claimed they were entitled to a quarter share of the farm each, but H claimed that the son and subsequently her had been in possession of the farm since the death of Mrs H in 1983. The judge dismissed H's claim so she appealed. Appeal dismissed.
