M needed to fell trees to reduce obstacles in the flight path. The defendants (D), in opposition to this development, entered the woods three days before the work began (without permission) with the intention of making it impossible for the works to be carried out. M was granted a RSC Order 113 (order of possession). D appealed on the grounds that M did not have sufficient interest in the wood to permit the granting of an exclusive possession order.
