It was held that when a contractual tenancy is held by joint tenants, but only one of them is resident when the tenancy expires, that tenant is entitled to protection under the act. However this Part 1 continuation tenancy was described as being hybrid: 'not a new tenancy or a statutory tenancy; it is merely the old contractual tenancy continued indefinitely by the act'.
