The respondent tenant (K),who was not one of the participating tenants, then sought to obtain a new lease under the Leasehold Reform, Housing and Urban Development Act 1993 s42. M claimed that as the section 42 notice had been served on the original landlord, it was not binding on the current landlord. "Held" Application succeeded: the section 42 notice did not bind M.
