Originating summons by plaintiff tenants (S) seeking a new tenancy under Landlord and Tenant Act 1954 Part II and application by defendant landlords (W) for an interim rent under s24A of the same Act. It was agreed that the building in question had reached the end of its useful life due to serious inherent defects ; meanwhile it needed to be strengthened temporarily. At issue were: 1) the length of term of the new tenancy, 2) rent of new lease, 3) amount of interim rent to be paid and 4) cost of temporary strengthening of structure. ChD 1) accepted S`s proposal for a term of 9 months as opposed to W`s suggestion of a shorter period, 2) assessed a rent of 29,000 as an annual figure, taking into account a comparable, significant modifications in the repairing obligations and a discount of 45% for a 9 months` term as contrasted with the 7 year term of the comparable, 3) determined an interim rent of 20,500 and 4) decided that S were liable to pay one half of the cost | ||
