520 _a"Lewin (Trading Standards Officer) v Barratt Homes Ltd." QBD 19 November 1999. In 1997, 2 prospective purchasers visited a show home and were shown a large picture of a house. They agreed to purchase a house, paid 10% of the purchase price and exchanged contracts. In November 1997, when they visited the completed homes, they were different from the pictures and the show house. They completed the transactions because they feared losing their deposits, but subsequently reported the situation to a trading standards officer. In January 1999, charges were brought against Barratt for offences against Property Misdescriptions Act 1991 s1(1). It was found that false statements had been made, but could not be charged under the 1991 Act. On appeal, appeal allowed.
