The claimants (R) were granted planning permission for a development which was subject to a time limit of five years. Work started just before the deadline, however it was then suspended and did not resume for four years. The work then stopped again and the defendant (SB) claimed that the planning permission had lapsed because R lacked the intention to complete the development. "Held" claim allowed.
