The property was then bought by the respondent who applied for planning permission to replace the building. Permission was refused, and an inspector found that residential use of the site had been abandoned. An appeal by the respondent was allowed, on the grounds that the intention of the previous owner was not to abandon the building. the SoS appealed. "Held" Appeal allowed.
