In July 1997 the defendant Langton and another (L), tenants of a public house stopped paying rent and commenced proceedings against the claimant landlord (I) for damages for breach of what was then Article 85 of the EC Treaty based on the beer tie. In July 1999 L issued her claim for relief from forfeiture. Relief from forfeiture was allowed because it was recognised that she had a Part 20 claim based on promises that she would be released from the beer tie and would be entitled to a rent review and be able to find a purchaser for the lease enabling her to pay off the rent arrears and other costs. Appeal allowed.
