520 _a"Farley v Skinner" CA 6 April 2000. Claimant (F) instructed defendant surveyor (S) to inspect a property and advise whether it would be affected by aircraft noise. S reported this was unlikely but on purchasing the property F discovered it was badly affected. Judge awarded F £10,000 damages for distress and inconvenience. S appealed and the appeal was allowed. It could not be concluded that the contract between the parties was anything but an ordinary surveyors' contract to supply information. Secondly, evidence did not support the finding that the noise caused physical inconvenience, discomfort or mental suffering.
