520 _aCA 8 December 1999. Claimants held a tenancy of premises owned by the defendant council . In October 1996 tenants commenced proceedings against the council's breach of repairing obligations. Proceedings for a statutory nuisance under Environmental Protection Act 1990 s82 were initiated and certain works carried out. Directions were given for an independent surveyor's report by the council. The principal issue for the experts to decide was whether rising damp or condensation had caused the disrepair problems.CC refused to allow council to use their expert who had been involved in the case since September 1997 as he was not an independent expert under the Civil Procedure Rules. CC's ruling upheld. Appeal dismissed.
