520 _aCA 8 February 2000. In 1994 respondent E granted a licence for use of business premises to appellant tenant W and another party of a room for a licence period of one year. Agreement renewed and, as extended, expired in September 1997.E held 20-year lease on the premises which contained an unqualified covenant against subletting. W insisted that it had a tenancy protected by Landlord and Tenant Act 1954 Part II which was first denied by E. E issued a s25 notice under 1954 Act accepting the existence of the tenancy on seeking possession on the grounds of s30(1)(g). E applied to CC for granting of a new tenancy. CC decided that 1994 agreement created a licence and not a tenancy and that the 1997 letter did not estop E from denying existence of tenancy. CC decision upheld. Appeal dismissed.
