520 _aLT 30 November 1999. In 1997 Mr and Mrs Jilla applied for planning permission to extend their house at 138 Hainault Road, Chigwell, Essex. Planning permission was refused, but granted on appeal on 16 September 1998. In accordance with the planning permission, Mr and Mrs Jilla applied under the Law of Property Act 1925 S84 to discharge, or modify a restrictive covenant affecting land in their freehold ownership. The application was objected to by the successor in title to the covenantee, Mrs Melbourne, arguing that her property would be reduced in value. 'Decision' the application was allowed under para (aa) and and an award of £10,000 was granted.
