The owner died before a contract was signed, and his sister brought possession proceedings against the defendant. Defendant claimed because he had paid some rent and started work on the farm, a proprietary estoppel had arisen. Judge found all agreements were 'subject to contract' and therefore void. Defendant appealed. Appeal dismissed.
