The tenants of W and B applied to the Leasehold Valuation Tribunal (LVT) for a determination of the premium to be paid to the freeholder S, and to the intermediate leaseholder, V, in consideration of a new, extended lease of a flat under the Leasehold Reform, Housing and Urban Development Act 1993 s48. The LVT determined the compensation payable to V, for the value of its intermediate lease, at £184. V appealed, contending that the LVT, in calculating the loss-of-profit rent, when all parties had agreed that the loss-of the gross rent should be taken, had been wrong. 'Held' appeal was allowed.
