520 _aLT 1 November 1999. 37 Old Park Road, Oldbury. By a written agreement dated July 1985 the owner agreed to sell the mid-terrace property to the claimant for £10,000 payable in instalments. In 1988 the council declared certain clearance areas, one which covered the property. The council under the the Housing Act 1985 s23, made the Sandwell (Old Park Lane, Oldbury) (Clearance Areas) Compulsory Purchase Orders 1988. The council notified the claimant that the interior was satisfactory, but the exterior had not been well maintained. One of the main issues was whether the owner/occupier supplement was payable, and whether claimant held interest in dwelling during qualifying period. 'Held' the amount of compensation was the agreed site value of £750.
