Landlord and tenant of commercial premises applied under the Landlord and Tenant Act 1954 s38(4)(a) for authorisation to waive an agreement for the security of tenure provisions contained in ss24-28 of the Act. Application granted by a district judge. In 1998, tenant served a request for a new tenancy and landlord began possession proceedings. Judge held since lease differed from the draft approved by the district judge that it was not excluded from security of tenure provisions of the Act. Landlord appealed. Appeal allowed.
