Five years later, M began proceedings for possession on the basis that X was granted an assured shorthold tenanvy. X contended that she moved into the house under a prior oral agreement and that the section 20 notice was defective. Court dismissed the claim. X appealed, claiming her tenancy was not an assured shorthold tenancy. Appeal allowed.
