520 _aCA 20 July 2000. A were tenants of a terraced house owned by the council (R). Before A became tenants R replaced windows in the property with units operated by removable keys. In October 1991 the property caught fire. The windows were locked and the keys were in the kitchen. Three children sleeping on the first floor died in the fire. A claimed damages from C for negligence and breach of statutory duty. Held there had been no breach of duty by C, as the decision to provide a lock with a removable key was one that a competent designer would have made at the time the windows were installed.
