In October 1991 the property caught fire. The windows were locked and the keys were in the kitchen. Three children sleeping on the first floor died in the fire. A claimed damages from C for negligence and breach of statutory duty. Held there had been no breach of duty by C, as the decision to provide a lock with a removable key was one that a competent designer would have made at the time the windows were installed. | ||
