520 _a"R v Derbyshire CC ex p Murray" QBD 9 October 2000. Following a planning application from Fitzwise Ltd, the respondent granted planning permission for extended use of a landfill site. The applicant, a local resident, challenged the grant of permission on environmental grounds, and claimed the council failed to give full consideration to the 'relevant objectives' in relation to the discovery and disposal of waste. Relying upon "Berkeley v SOS Environment" the council's decision to grant permission on the basis of an application accompanied by a flawed environmental statement was unlawful. "Held", application refused.
