Looks at Scottish cases, particularly the recent "County Properties Ltd v The Scottish Ministers", which confirms that aspects of the UK planning system do contravene European human rights legislation. Elements of the consultation process infringe upon the Convention Rights. The European Court also found that the practice of referring inspectors' decisions to the High Court contravened the Convention.
