520 _aCA 13 April 2000. A CC judge made an order for possession of a property belonging to A on the grounds of arrears of rent owed by the tenant (B). By consent, B agreed to pay A £14,503 rent arrears plus interest, less an agreed deduction for breach of A's repairing obligations. However, the judge suspended the possession order on terms that the tenant should pay the current rent of £49 per week, and £5 towards discharge of the debt. This meant the debt would not be paid off for 55 years. A appealed. Held, appeal allowed. An order for possession was made within 28 days. Suspended possession orders should not be made in cases where this would involve the payment of arrears over an almost indefinite period.
