520 _aChD 1 November 2000. "Hallisey v Petmoor Developments Ltd". The claimant's lease included a covenant by the defendant landlord to maintain and repair the main structure of the block of flats. When water penetrated the flat from the terrace of the rooftop flat above claimant's flat, the claimant sought summary judgment , under CPR Part 24 for performance of the defendant's covenant. The defendant argued that the defect had not affected the main structure of the building. "Held" the defendant was ordered to carry out repair work to the terrace.
