The order was made under the Wildlife and Countryside Act 1981 s53(2)(b) and changed the status of the way from road used as a public path to that of a byway open to all traffic. M objected to the modification, and argued that it could not be described as a byway under the Wildlife and Countryside Act 1981 s66(1). The application was dismissed, and the decision was confirmed after a public inquiry by the SoS. Appeal dismissed. | ||
