520 _aCA 31 July 2000. The respondent county council issued a modification order in relation to a public right of way which ran through the applicant's' land. The order was made under the Wildlife and Countryside Act 1981 s53(2)(b) and changed the status of the way from road used as a public path to that of a byway open to all traffic. M objected to the modification, and argued that it could not be described as a byway under the Wildlife and Countryside Act 1981 s66(1). The application was dismissed, and the decision was confirmed after a public inquiry by the SoS. Appeal dismissed.
