S's investment manager visited the property but rejected it on the grounds that its yield pricing was too high. In October 1997 the property was officially put on the market with Savills. A director of Richard Ellis approached S with details of the property. In November 1997 Richard Ellis made further contact and submitted a lower bid than the asking price. S purchased the property and paid an agreed commission of 1% of the purchase price. Judge found that E was the effective cause of the purchase and was entitled to 1% commission. S appealed. Appeal allowed on grounds that the commission had not been earned. | ||
