The applicant was a tenant of a flat owned by Croyden LBC and was seeking to exercise her right to buy the flat under provisions in the Housing Act 1985. The flat fell on green belt which meant it came under terms in the Green Belt (London and Home Counties) Act 1938 and required sale consent from the SoS. When the SoS refused consent, the applicant appealed contending that the right to buy provisions in the Housing Act impliedly repealed those in the 1938 Act. Held, appeal allowed.
