H disputed the fact that alternative accommodation was available. CC made an order for possession and H accepted the accommodation. H was entitled to a house loss repayment. In November 1997 I deducted £77.64 arrears of rent from the home loss payment and H sought a declaration that I was not entitled to make any deduction. CC refused declaration and H appealed. Held, I was entitled to set off rent arrears against the tenant's entitlement to a home loss payment under the Land Compensation Act 1973. | ||
