520 _aCA 10 June 1999. Claimant tenant (H) occupied premises in North London. Defendant (I) sought to obtain funding to demolish and redevelop properties on the estate. H disputed the fact that alternative accommodation was available. CC made an order for possession and H accepted the accommodation. H was entitled to a house loss repayment. In November 1997 I deducted £77.64 arrears of rent from the home loss payment and H sought a declaration that I was not entitled to make any deduction. CC refused declaration and H appealed. Held, I was entitled to set off rent arrears against the tenant's entitlement to a home loss payment under the Land Compensation Act 1973.
