520 _a"Marshall v Bradford Metropolitan District Council", CA 27 April 2001. In January 1989 the council (A) sought to recover arrears of rent from tenants (B). A obtained an order for possession on the ensuing grounds: the order would not be enforced if B paid off the arrears in instalments, and paid these in full. Over the next two years the arrears were paid off irregularly, and at some stage B left the property to live elsewhere. In April 1999 B sued A for breach of repairing covenants, and paid off the outstanding arrears in June 1999. Judge found that the tenancy had not been revived, and that B was a tolerated trespasser. Appeal dismissed.
