Defendants (W) were appealing against a ruling that ordered them to pay the costs of repairing a chancel of a parish church. W were owners of Glebe Farm and were legally obliged to maintain the chancel. This could be enforced by the claimant (P). In 1994 P issued proceedings against W to recover the cost of repairs. Judge found against the defendant who appealed. The issues included whether P was a public authority within Human Rights Act 1998 s6. Held, appeal allowed.
