520			_aExamines the challenge to the right of the Construction Industry Training Board (CITB) to make a levy on employers in the construction industry under the Industrial Training Act 1982 s11 in "Buildstone Ltd v SoS Education and Employment". The application for judicial review was refused with the court dismissing B's contention that differential between the levies for PAYE employees and labour only sub-contractors was unlawful and discriminatory as the levy was not punitive but intended to provide fairness in the burden of training whilst s12 of the Act covered differential between employers of the two groups of workers.
