520 _a"Sheffield CC v Hopkins", CA 19 June 2001. Landlord (S) issued proceedings against defendant tenant (H) for non payment of rent. Judge granted a possession order suspended on terms requiring tenant to pay arrears. Terms were not complied with and H appealed against suspension of resulting warrant for possesson , citing non compliance was due to illness. S sought to cite evidence of nuisance and H raised arguments concerning the discretion permitted to the court under the Housing Act 1985 ss7. CA held that the CC was entitled to consider matters other than those relied on in possession proceedings. Appeal allowed.
