| 520 | _aCLCC 2 June 2001. The appellant, F, errected a new building and in order to complete the works a building adjacent to the respondent's W's premises had to be demolished. Between 1996 and 2000 several awards were made, within the meaning of the London Building Acts (Amendment) Act 1939, relating to works affecting W's property. Several issues arose between the parties. On 2 February 2000 W's surveyors, believing that F's surveyor was not going to concur with the outstanding issues, made an ex p award. F appealed, contending the surveyor was not entitled to make an ex p award, and that W were not 'owners' for the purposes of the 1939 Act and thus not entitled to the protection of its provisions.
