520 _aCA 10 May 2001. The tenants (T) held two leases from Sun Life (S). S had informed T that it would resist any renewal of the tenancies on redevelopment grounds and the tenants decided to relocate, purchasing adjoining land to the original site. However, T then served two requests for new tenancies; S first opposed it under the Landlord and Tenant Act 1954 s30(1) then withdrew their opposition. T did not reapply for the tenancies and gave up possession. It was found that T had made false proposals in their section 26 notices ; it was decided that the section 26 notices were not valid and T were not entitled to statutory disturbance payment under s37. T's appeal was allowed as the evidence of a tenant's state of mind was held to be inadmissible and legally irrelevant.
