It was designed to provide an alternative to court, by enabling landlords and tenants to have the terms and the rent payable under a new lease decided by a valuer or a solicitor, acting as an arbitrator or independent expert. Considers the past and future performance of PACT. Despite the flexibility and cost savings it offers, latest statistics indicate very limited use of PACT. Considers reasons for this and suggests that in most cases an experienced arbitrator or independent expert can deal with an opposed lease renewal. Predicts that the introduction of CPR Pt 56 on 15 October 2001, which will bring additional costs and extra work, will lead to increased use of PACT.
