Considers some of the concerns over CPR 56, but contends that most arise from misunderstandings and will not be borne out in practice. Suggests that concerns arising from CPR 56(10) and (11) should be allayed by forthcoming amendments to the practice direction. Argues that in practice there will probably be little difference in the conduct of litigation. Warns that parties will find it harder to delay resolution by years.
