The property industry claims that deals of £70m do not create monopolies and OFT's approach is inconsistent as not all deals at this level are investigated. The interpretation of property as an 'entreprise' under the Fair Trading Act 1973 s63(2) enables OFT to look at mergers beyond corporate entities. Discusses how the British Property Foundation has been working to change OFT's regulations so fees are only payable if a full investigation is required and to amend the definition of 'entreprise' so property acquisitions are not included.
