520 _aThe Law Commission has published a discussion paper on the "Pointe Gourde" rule which concludes that the law on 'disregarding the scheme' when assessing compensation for land compulsorily acquired is muddled and needs a complete review. This article briefly outlines the "Pointe Gourde" rule; looks at the complex and inconsistent provisions contained in the Land Compensation Act 1961; considers possibilities for reform and highlights the issues involved. A Law Commission consultation paper on a framework for a new code will be published in 2002.
