Article examines contracted mediation, a new method of preventing disputes from arising. In contrast to traditional mediation, contracted mediation aims to provide a problem-solving mechanism before the situation turns sour. Two mediators are appointed at the start of a project and are at hand throughout the project if differences arise. Contract mediation puts the needs of the participants first and does not allow decisions to be imposed. In addition, contracted mediation happens while all the parties are working on the project so information regarding differences is less likely to get distorted. | ||
