| 520 | _aCA 31 January 2002. "R (on the application of Anglian Water Services Ltd) v Environment Agency". The respondent was a sewerage undertaker and decided it was not under a duty to provide a new public sewerage to three villages in its area. The villages applied to the Environment Agency for determination. The agency concluded the respondent was obliged to provide a public sewer to serve each of the four villages under its duties contained in the Water Industry Act 1991 s101A. A claim by the repondent to quash the agency's determination was allowed on the grounds that the agency had misconstrued s101A and not carried out an appropriate practicability test.
