520 _aCA 31 January 2002. "R (on the application of Anglian Water Services Ltd) v Environment Agency". The respondent was a sewerage undertaker and decided it was not under a duty to provide a new public sewerage to three villages in its area. The villages applied to the Environment Agency for determination. The agency concluded the respondent was obliged to provide a public sewer to serve each of the four villages under its duties contained in the Water Industry Act 1991 s101A. A claim by the repondent to quash the agency's determination was allowed on the grounds that the agency had misconstrued s101A and not carried out an appropriate practicability test. The agency appealed. "Held": appeal dismissed.
