It was agreed that compensation would be based on open market value. At issue was whether there could be any hope value where the established planning policies were against any relevant development. The defendant council (E) said there was no prospect of any planning permission for development of the land as it was within a Green Belt. E offered £30,215 compensation on the basis of existing use but alternatively, should the tribunal accept that there was development potential in the land and allowance for hope value, the amount of compensation proposed by E was £95,700. "Held", compensation payable by E to Y was £370,000.
