Respondent council (W) received an application for a Lawful Use Certificate for proposed use of dwellinghouse as residential accommodation for six mentally ill people plus one carer, under Town and Country Planning Act 1990. Certificate was available as change from existing to proposed use did not need planning permission. W refused as seven people would fall outside remit of Class C3. Applicant (A) appealed to SoS (S). Appeal allowed, and certificate allowed. W challenged decision under 1990 Act s288. Certificate was quashed, as inspector should not have taken use as by large family. S appealed. Appeal dismissed.
