Claimants (T) sought compensation for the compulsory purchase of a four storey terrace building comprising five houses with a redevelopment site at rear which was in a conservation area. Valuation date was 11 December 1995. T made two valuations of the building:(a) refurbishment basis assuming available grants (b) demolition basis. Council (W) valued site at rear only and claimed no refurbishment grants would be available and demolition consent would not have been given. The building was duly refurbished after compulsory purchase mainly from W's funds. "Held" that the compensation payable by W to T should be £97 500.
