It was held that where there is an oral agreement between the parties, it is necessary that all the terms, and not merely the existence, of a construction contract had to be evidenced in writing if the contract was to be capable of being referred to adjudication under the Housing Grants, Construction and Regeneration Act 1996 s107. The appellant has appealed.
