520 _aFollowing the Lord Chancellor's department's (LCD) response to two recent consultation papers on distress for rent, article provides an update and summary of the main proposals. Discusses the following areas with LCD responses: landlord/creditor required to give 72 hours' notice; distrainors required to carry an identity card and give a minimum amount of information; distress for rent to take place between 0800 and 2000; no service charges recoverable by distress; forced entry to require prior notice and judicial authority; distress only levied if outstanding rent exceeds one quarter of the annual sum; bailiff not allowed to take goods if they do not cover expenses plus 10% of the debt; three forms of legal control; a list of exempted goods; abolishing poundbreach; fees; and removing a landlord's priority. The LCD plans to publish a white paper in early 2003.
